Public Holiday Observance Rules in Puerto Rico

1. Work on Public Holidays

Employers in Puerto Rico are required to pay a premium wage to employees who work on public holidays. This ensures fair compensation for employees who are required to work during official holidays. Source

2. Holidays Falling on Weekends

According to the Political Code, when an official holiday falls on a Sunday, it is observed on the following Monday. This practice ensures that employees still receive a day off in observance of the holiday. Source

3. Observance by Sectors

Public Sector: All public offices are mandated to close on official holidays as defined by the Political Code. Source

Private Sector: While not legally required, many private businesses choose to close on official holidays. However, if they remain open, they must comply with labor laws regarding holiday pay.

4. Additional Observance Rules

The Political Code also allows for the declaration of additional holidays by the President of the United States, the Governor of Puerto Rico, or the Legislative Assembly for observances such as days of fasting, Thanksgiving, or other holidays. Source
