Public Holiday Observance Rules in Saint Lucia

1. Work on Public Holidays

General Rule: Employers are prohibited from requiring employees to work on public holidays unless the employee agrees and is compensated with overtime pay. Source

Overtime Compensation: The overtime pay rate for work on public holidays is specified in Section 32(2) of the Labour Act. Source

Exceptions: The prohibition does not apply to employers engaged in:

  • Hospitality services (e.g., hotels, hostels) operating lawfully on public holidays.
  • Essential agricultural work.
  • Continuous shift operations.
  • Industrial establishments where work is necessary to maintain operations or prevent health and safety hazards.
  • Emergency work.
  • Protective services.

Additionally, the Minister may, by order published in the Gazette, exempt certain industries or enterprises from these requirements after consulting with relevant trade unions and employers' organizations. Source

2. Public Holidays Falling on Weekends

If a public holiday falls on a Sunday, the following Monday is observed as a bank holiday. If any of the specified holidays fall on a Sunday or another bank holiday, the next day not being a holiday is observed as a bank holiday, unless another day is appointed for the purpose. Source

3. Observance by Sectors

Public Sector: Government offices and institutions close on all official public holidays.

Private Sector: Private businesses are also expected to observe public holidays. If operations continue on these days, employers must adhere to labor laws regarding employee consent and overtime compensation.

4. Additional Observance Rules

Cultural Practices: While not mandated by law, it is customary for businesses to respect local cultural practices during public holidays and festivals.
