Public Holiday Observance Rules in Saint Kitts and Nevis
1. Work on Public Holidays
General Rule: Employees are entitled to a day off on public holidays.
Exceptions: Certain essential services may require employees to work on public holidays.
Compensation for Work on Public Holidays:
- Overtime Pay: Employees who work on public holidays are entitled to double their normal hourly rate for the hours worked. Source
2. Annual Paid Leave
Entitlement: Employees are entitled to an annual paid holiday of not less than 14 days, excluding Sundays and public holidays, upon the completion of each year of employment. Source
Scheduling:
- The annual paid holiday should be taken in one period. However, if both employer and employee agree in writing, it can be taken in two periods.
- The holiday must be taken within three months after the entitlement date unless postponed with the written consent of the Labour Commissioner.
Payment: Employees should receive their holiday pay no later than the day immediately preceding the commencement of the holiday.
3. Public Holidays Falling on Weekends
If a public holiday falls on a Sunday, the following Monday is observed as a public holiday. Source
